Todd Dolin's murder trial has been moved out of Marshall County, as Circuit Judge Mark Karl on Tuesday signed an order changing the venue to Tyler County.
The change came about after a mistrial was declared in March when it was decided 24 potential jurors could not be found in Marshall County. After interviewing 30 of a potential 46 jurors and finding no candidates, Karl declared the mistrial.
Dolin's attorneys, William Gallagher and Keith Hart, requested a change of venue on March 7. That motion was addressed Tuesday, with Karl ordering the case be transferred to Tyler County.
Gallagher then made a motion asking for a jury questionnaire to be sent out to potential jurors in Tyler County, though the state objected to that motion.
Karl overruled the state's objection and set a status hearing to address the jury questionnaires for May 23 in Tyler County.
Dolin's case has been scheduled for trial several times, including this past October. That trial was canceled after Dolin's attorneys requested to be removed from the case and new attorneys were found.
Dolin is charged with the July 18, 2008 murder of his girlfriend, Lua Zervos-Wolverton, 43, at the Dallas post office. Zervos-Wolverton was the postmaster of that office.
Court documents allege that on July 18, 2008, Dolin entered the Dallas post office with a 12-gauge shotgun and shot Zervos-Wolverton at point-blank range. Zervos-Wolverton was able to speak to a Marshall County 911 dispatcher and tell a State Police trooper at the scene that "her boyfriend, Todd Dolin, shot her." She told the trooper the two had been having relationship problems.
Emergency personnel transported Zervos-Wolverton to Morgantown via medical helicopter, where she died a short time later. Police apprehended Dolin in Zanesville, Ohio.
