MELBOURNE wholesalers warn they will take legal action unless the State Government compensates them for moving to Epping.
"We've spent $200 million as a group on warehousing and fitouts (at Footscray) in the last 15 years," wholesaler spokesman Shane Schnitzler said.
    "Warehousing is the achilles heel of the deal on moving to Epping."
    Mr Schnitzler, who heads up the Fresh State wholesaler group, said the previous Labor government had struck a compensation deal offering rental discounts at Epping.
    Mr Schnitzler said the Coalition Government had refused to match the offer.
    "We asked (Major Projects Minister) Denis Napthine about it, but he said he knew nothing of a deal," he said.
    "If we don't get a common-sense approach with equity (from the government) ... then there's a class action we've had parked since 2007 we'll use."
    Dr Napthine said the Government would back the Epping move, after supporting a campaign against it in 2006.
    Dr Napthine has refused to specify what rental increase wholesalers would face if they move to Epping when Footscray is closed in 2014-15.
    He said the Government had moved to offset higher rents by cutting tenant contributions to the $500-$670 million cost of the new market.
    But wholesalers are warning they will walk away from investing in the market and set up warehouses elsewhere in Epping if the Government refuses to offset their losses on the Footscray closure.
